The Royal Montreal Golf Club Terms of Use

Please read carefully the Terms of Use (hereinafter referred to as the “Terms of Use”) of The Royal Montreal Golf Club, whose headquarters are located at 25 Chem. South Ridge (H9E 1B3), in the city of Ile-Bizard, in the province of Québec, Canada (hereinafter referred to as “RMGC” or “we”).

RMGC operates the website “Rmgc.org” (hereinafter referred to as the “Platform”). By choosing to use the Platform and RMGC’s services, you, as the end user or the organization you represent or work for (hereinafter referred to as the “User” or “Users”), agree to all the Terms of Use set forth below, which govern the content and use of the Platform, as well as the “Privacy Policy.”

These Terms of Use legally bind the User and RMGC (hereinafter referred to as the “Parties”). The Parties are entitled to invoke these Terms of Use and take all necessary measures to enforce them.

If the User does not accept these Terms of Use or, as applicable, the Terms of Use as modified from time to time, they must not, or must no longer, use the Platform.

Access and Use of the Platform

By browsing the Platform, you confirm that you have read, understood, and accepted the Terms of Use. The Platform is accessible from any computing device (computer, smartphone, tablet, etc.).

General Features of the Platform

The Platform’s features allow you to:

• View RMGC’s service offerings;
• Access content created or distributed by RMGC;

Service

The Platform is accessible at all times. However, it may be temporarily unavailable due to updates or technical issues. RMGC is not responsible for service interruptions or updates. RMGC strives to carry out updates when traffic on the Platform is at its lowest.

RMGC does not guarantee that the Platform, or any part of it, will operate on specific hardware or devices. Additionally, the Platform may experience malfunctions and delays inherent to the use of the Internet and electronic communications.

RMGC reserves the right to add, remove, and modify any content, or parts of it, on the Platform. RMGC cannot be held responsible for errors, typographical mistakes, or bugs.

RMGC also reserves the right to suspend or terminate your access to the Platform or its features without prior notice when it is reasonable to do so, particularly in the following cases:

• If, for any reason, we cease to provide the Platform’s services;
• If your use of the Platform has been inappropriate or has violated the spirit of the Terms of Use in any way;
• If we reasonably believe that the Platform is at risk of fraud or abuse;
• If our IT infrastructure fails, experiences breakdowns, or requires maintenance;
• If we are ordered or recommended to suspend access to the Platform by security services, a court, or a competent regulatory authority.

Each User of the Platform agrees, without limitation, to refrain from:

• Using the Platform in a way that could damage, disable, overload, or compromise it;
• Disrupting the security of or otherwise abusing the Platform, any service, system resources, servers, or networks connected to the Platform or to affiliated or linked sites accessible through it;
• Disturbing or interfering with the use or enjoyment of the Platform by other users or linked services;
• Uploading, displaying, or otherwise transmitting a virus or other harmful, disruptive, or destructive file or program to the Platform;
• Using a robot, spider, or other automatic device or manual process to monitor or copy Platform pages or its content;
• Transmitting emails, chain letters, spam, or other types of unsolicited mass emails through the Platform;
• Attempting to gain unauthorized access to the Platform or to restricted sections of it.

Additionally, the User agrees that they are solely responsible for all actions and communications undertaken or transmitted on their behalf and agrees to comply with all applicable laws regarding their use or activities on the Platform.

Intellectual Property

Unless otherwise indicated, all intellectual property rights (trademarks, copyrights, etc.) (hereinafter referred to as “Intellectual Property”) related to the Platform are the exclusive property of RMGC. You may not copy or use the material, structure, menu, appearance, or features displayed on the Platform without the explicit consent of RMGC.

Certain names, words, titles, expressions, logos, icons, graphics, designs, domain names, or other elements contained on the Platform may be trademarks or trade names, whether registered or unregistered (for the purposes of these Terms of Use, they are collectively referred to as “Trademarks”). These Trademarks are protected under applicable Canadian and international trademark laws and, as the case may be, are the exclusive property of RMGC.

Without limiting its scope, RMGC’s Intellectual Property includes, but is not limited to, the following elements:

• All logos, designs, graphics, photos, videos, trademarks (registered or not), symbols, texts, expressions, words, and any general content on the Platform that is not already subject to intellectual property rights;
• All software, APIs, and materials made available through the Platform;
• All databases made available through the Platform; and
• All content offered by the Platform for free download.

Unless otherwise stated, all information provided on the Platform belongs to RMGC and is protected under applicable laws. Moreover, the information may not be copied, displayed, distributed, downloaded, licensed, modified, published, reproduced, reused, sold, transmitted, or used for derivative, public, or commercial purposes without the explicit written authorization of RMGC. The information is protected under Canadian copyright and trademark laws, as well as the laws of the countries hosting the Platform.

Images and text on the Platform that are downloaded, copied, saved, or printed remain subject to these Terms of Use. You must ensure that all copyright and trademark notices remain intact. The content of the Platform may be modified at any time without notice. For further information on authorization to use, reproduce, or republish any information on the Platform, please contact us at jkishfy@rmgc.org.

Nothing in these Terms shall be construed as granting the User any license or rights under copyright or trademark laws.

Any unauthorized downloading, retransmission, copying, or modification of Intellectual Property or data contained on the Platform may violate laws, including those related to trademarks or copyrights, and could result in legal action against the User.

Subject to applicable laws, any content imported, created, submitted, or stored by the User grants RMGC a worldwide, non-exclusive, free, transferable, and sublicensable license. This license allows RMGC to host, use, modify, reproduce, publish, publicly display, create derivative works, or distribute your content. Under this license, RMGC may only use your content for the operation, promotion, or improvement of its services. If you wish to terminate this license, simply delete your account. However, content you have shared will still be visible to other Users; you may request its removal, subject to certain conditions, by contacting the designated representative at jkishfy@rmgc.org. 

External Links

When using a hyperlink, the User may leave the Platform to access external content (hereinafter referred to as “External Websites”). In addition to its own content, RMGC provides Users with links to External Websites, including service providers’ sites, mainly to facilitate the services requested by Users and to provide informational resources.

RMGC has no control over the content of these External Websites and assumes no responsibility for their accuracy, precision, completeness, authenticity, timeliness, or suitability. RMGC disclaims all liability, particularly for any direct or indirect damages or consequences arising from the use of content found on these External Websites.

RMGC has no influence over the content of External Websites linked from the Platform and assumes no responsibility for the selection of these links, their content, or any modifications made to them after the links were established. RMGC does not request the transmission of information, does not select the recipients of the transmitted information, nor does it modify the information itself. Furthermore, RMGC does not automatically store these external links temporarily.

As a result, the responsibility for the content of External Websites accessible via hyperlinks rests solely with their operators. Users are strongly encouraged to review the terms of use and privacy policies of these External Websites.

Additionally, RMGC cannot guarantee that these External Websites or their content do not violate any laws, including copyright, trademarks, or third-party rights, nor can it guarantee that they are free of viruses or other harmful components. No warranty is given regarding the authenticity of documents available on the Internet.

Social Media

The following conditions apply when you access a social media page, user account, website, network, or any application contained therein that has been designed and managed by a social media platform (individually referred to as a “Social Media” and collectively as “Social Media Platforms”).

General Statement:

By using RMGC’s Social Media pages and submitting a comment, photo, video, or any other content, you (along with your parent/legal guardian if you have not reached the age of majority in your province or territory of residence) agree to be bound by RMGC’s Terms of Use and Privacy Policy, as well as the Terms of Use of third-party Social Media providers, and to comply with them.

You also consent to RMGC copying, editing, publishing, translating, and distributing your comment, photo, video, or other content posted on a Social Media Platform, without compensation.

Social Media Terms of Use

Some of the comments and other content posted on RMGC’s Social Media pages may not reflect the opinions of RMGC. Therefore, you agree not to post or submit any information, posts, links, or any other content on RMGC’s Social Media pages that falls into any of the following categories:

• Defamatory content
• Abusive content
• Counterfeit material
• Obscene content
• Misleading content
• Illegal content
• Any content that otherwise violates the rights of others (including privacy rights)
• Any content containing advertisements
• Promotional materials or any form of unsolicited solicitations
• Content with falsified origin or source
• Any financial or personal information about yourself or another person
• Any information that RMGC deems to be in violation of its Terms of Use
• Any information, message, link, or content that RMGC considers to fall under any of the above categories will be removed immediately, without any liability on RMGC’s part.

Furthermore, RMGC does not assume responsibility for monitoring messages posted on Social Media.

RMGC disclaims all liability regarding Social Media platforms owned or operated by third parties, including any loss or damage, direct or indirect, resulting from any action or decision taken by you or another person concerning the use of Social Media websites.

Disclaimer, Warranty Exclusion, and Indemnification

RMGC does not guarantee the accuracy, completeness, quality, relevance, or content of the information available on its Platform. This information is provided “as is,” without any express or implied warranties or conditions, including, but not limited to, implied warranties and conditions of merchantability and fitness for a particular purpose, except in jurisdictions where the exclusion of warranties is not permitted.

RMGC is not responsible for content posted on the Platform by Users or for any damages that may result from such content. Each User is responsible for the content they share on the Platform and must not use the Platform in a manner that violates applicable laws in Québec and Canada.

If the User is a consumer under the Québec Consumer Protection Act, the law does not permit the exclusion of certain warranties or the limitation of RMGC’s liability for specific damages. In such cases, the User may have additional rights and may not be subject to some of the limitations stated below.

Except where the Québec Consumer Protection Act applies, RMGC shall not be held liable for any direct, indirect, special, incidental, consequential, or other damages of any kind, including loss of income, profits, or anticipated economic benefits resulting from the use or inability to use the Platform, the information, documents, or software available on it, even if RMGC has been advised of the possibility of such damages or if such damages could have been reasonably foreseen.

RMGC acts as a third party facilitating connections for services with participating therapists. By using the Platform to access these services, Users enter into a direct service contract with the therapists and not with RMGC.

You understand and agree that RMGC cannot be held responsible for the outcome of transactions between therapists and Users of the Platform. RMGC has no control over, nor any responsibility for, the legality or use of services obtained through the Platform.

It is the responsibility of the therapist and the client to resolve any dispute or claim regarding a service obtained through the Platform.

As a User, you agree to indemnify and hold RMGC, along with its directors, officers, shareholders, partners, employees, agents, consultants, and other representatives, harmless from any claims, liabilities, losses, and expenses (including legal fees) arising from your use of the Platform and/or any violation of these Terms of Use, whether by you or any third party using your account.

You may not use or export any information, nor any copy or adaptation of the information, in violation of applicable laws or regulations.

Modification of these Terms

We may occasionally update these Terms of Use. Continued use of the Platform constitutes the User’s agreement to these Terms of Use and any updates.

However, when the Québec Consumer Protection Act applies, RMGC will notify Users of the Platform at least thirty (30) days before any modification takes effect. If the User refuses these modifications and wishes to terminate their agreement, they will have up to thirty (30) days following the effective date of the modifications to notify RMGC and terminate their obligations without cost or penalty.

Interpretation

The section headings above are provided for reference only and do not affect the construction or interpretation of these Terms of Use.

Whenever required by the context, any word written in the singular also includes the plural, and vice versa; any word written in the masculine gender also includes the feminine, and vice versa.

We, RMGC, a legally established company, place great importance on protecting your privacy in the evolving landscape of new technologies.

We only collect professional information (Name, First Name, Professional Email, Nature of Your Request) through the contact form on our website. We recommend that you do not include personal information in your contact message. However, if you do, you consent to RMGC processing such personal data in compliance with applicable laws.

The only personal information that may be collected about you on our website is through cookies. These details include:

• Web preferences and cookies
• Browsing activities

We use your information exclusively to communicate with you, provide the services you requested, analyze our website traffic, and enhance your experience on our website. Personal information we collect is stored in Québec and will not be transferred outside this jurisdiction without your consent. RMGC does not retain personal information for purposes other than those for which it was collected and adheres to legally mandated retention periods.

You have the right to request access to your personal data and to correct or remove it from search engines. You may also withdraw your consent by contacting us, though this may impact our ability to provide you with services.

We may modify this Privacy Policy at any time. We encourage you to review it regularly to stay informed about how we handle personal data.
